Present: Supervisor Frank X. Quinn, Councilmen, Robert E. Bailey, Mark A. Quinn, Edward F. Rosenberg and Councilwoman Valerie M. DiGiandomenico

Supervisor Quinn called the meeting to order at 7:30 PM. Supervisor Quinn gave the Invocation and led us in the Pledge of Allegiance.
Supervisor Quinn asked the Town Clerk, Linda C. Neals, to call the roll. Everyone was present and accounted.
Supervisor Quinn – “The next item on the agenda is a briefing by Colonel German of the 109th Airwing National Guard. He was called out of town and so he will not be here tonight.
The 109th is going to be deployed. I can’t say exactly where but it will be the Afghanistan/Iraq area. They are doing a lot of practice flights that you and I haven’t seen or heard around here before. This is to get their skill levels up
to where they need to be in a combat zone. The approaches are different, the times are different, the flights are different and the practice runs are more frequent. They are also doing some off-the-site, so they are not just practicing here.
Please beware these are the things that are going on for the safety of our air crews and the Colonel will be here in the future.”
Town Council Reports:
Councilman Quinn – “I would like to announce the Annual DARE Golf Tournament; it is their biggest fundraiser. It is on June 2nd, at the Fairways of Halfmoon and they are still looking for foursomes and also still looking for sponsors.
I attended the Woodhaven Homeowners Association meeting last week. They had quite a few questions especially regarding paving concerns, the new sewer district that is currently under a second petition attempt and new development concerns. I was able to answer most of their questions and with the aid of the Highway Department, I thank Rick LeClair and also the Planning Department, Kevin Corcoran we were able to respond to all of their requests.”
Councilman Rosenberg – “From our Assessor’s Office we had 428 assessment changes, notices that just got mailed out of which included new construction, building projects that happened since our last meeting and the attempt to resolve some inequities or errors in our tax rolls. There were 30 building permits reviewed for March, they inspected five new homes in April and we are currently accepting resumes for our Tax Assessors position. They can be forwarded to our Town Administrator, Tony Germano here at Town Hall.
Planning and Zoning Department and Commission we had one project that was held up in Corporations Park waiting stormwater management review by Kestner Engineering.
Burnt-Hills Rowing Association submitted a site-plan review to construct an addition on their existing building.
The Hess Station proposal on Freemans Bridge Road has site-plan review. The car wash has been removed from that project and it is moving forward.
The Glenville Town maps, the new updated JAMAPCO maps are available at Town Hall for the sum of one dollar and they are available at the Clerks’ Office.”
Supervisor Quinn – “The first public hearing on our agenda tonight is to consider the zoning map amendment on the application by Lowe ’s Home Centers, Inc. to change the zoning on the 19 acre site off Freemans Bridge Road from Research/Development/Technology to General Business.
Supervisor Quinn opened the public hearing at 7:40 pm.
Neil Turner – “I went to the Planning and Zoning Commission and listened to them spend lots of minutes talking about the color of awnings, the kind of lights we have on. All of this they are saying we want you to comply with the Master Plan and then
we get into the other end of the spectrum where we have large projects like Lowe’s and the Glen Cove development. I wonder are we going to have a master plan or aren’t we? If we aren’t then we should just drop the thing and just let development go
on.
As far as Lowe’s is concerned I do oppose it. I would like not to have that here.”

Supervisor Quinn – “The next item is also a public hearing to hear input on the Draft Erosion, Sedimentation and Storm Water Management Local Law.”

Supervisor Quinn – “The next public hearing is a proposed extension to Sewer District No. 2 relating to the Mortensen Apartment Project on Route 5.”

Supervisor Quinn – “The next item is a public hearing for the proposed extension to Water District No. 11 relating to the Mortensen Apartment Project on Route 5.”

The following people spoke during privilege of the floor.
Bob Mortensen – “I am not clear on how everything works for the sewer district but I have to go through the same process through Scotia and I would like to ask is if it is possible if the Board could vote on this tonight so that process could move forward?”
Supervisor Quinn – “Our custom and tradition, procedure in the past has been first to have the public hearing at one meeting and then vote on it at the following meeting. That is our typical policy and procedure.”
Mr. Mortensen – “I’ve met with the Department of Public Works and they had no objections and they are in favor of this. Is it possible to take care of it tonight to save me a month and try to build in the springtime and not in the wintertime?”
Supervisor Quinn – “We would like to accommodate you but we didn’t prepare the resolutions. As far as I know it will be on for the next town board meeting. If we have a subsequent meeting between here and the next regularly scheduled town board meeting held the third week of June (June 20th), if we have a special meeting between here and there then we can certainly put that on the agenda to vote it then.”
Councilman Quinn – “Mr. Supervisor, technically we could do it at the prior weeks work session and at least give him a weeks head start.”
Supervisor Quinn – “Normally the first and the third Wednesday’s are the board meetings, the second and fourth Wednesday’s we reserve for work sessions. Obviously we are up to the third week now, next Wednesday the 23rd is the Memorial Day Parade but we will have either the 30th of May or the 6th of June.”
Terresa Bakner – “I am here tonight on behalf of Lowe’s and we came here tonight in case any of the Board members had any questions or were looking for any information with respect to Lowe’s rezoning project. I just wanted to let you know that we are here and if you have any questions we would be more than happy to answer them.”

Supervisor’s Comments:
Supervisor Quinn shared the following information:
May 7th – We had a meeting with the City of Schenectady representatives and reviewed the status of their sewer facility and their equipment as it relates to the sewer project that we are looking at. After discussing what they have, how old is it, how much replacement is there, how many things they would either have to repair or replace in their system and so forth? We are only responsible under the terms of the contract for that part that we are directly involved in so if
anything broke and had to be replaced between Freemans Bridge Road and a couple thousand feet over to the power plant then we share the costs for the repair and/or replacement, not everything else that is going on in the City of Schenectady.
Everything else going on in the city has to do with either the city or the other towns so we are not on the hook for those repairs or replacements. They also have a reserve capacity now, unused capacity of about 4 million gallons of sewage that they can take. If something breaks or gets repaired in the system in effect the bottom line would be about a 2% cost.
As we are considering, should we or shouldn’t we be in our own sewer district, building our own sewer treatment plant with the Village of Scotia it doesn’t sound like it is going to be too cost effective other than to stay where we are. We will get
more information, we will digest it and between us and the Village we can decide if we want to proceed.
On Tuesday the 8th the Town Administrator and I went over to a meeting at Schenectady County. There is a dilemma between the County and Conifer Park and that revolves around the fact that when they laid the main sewer line up Maple Avenue, Conifer Park was supposed to be sharing in the costs of that sewer line. For whatever reason the County has not collected money, whether it is the County’s fault, Conifer Park’s fault, whatever and so we shared in the meeting Conifer Park is up to date with all payments to the Town of Glenville so we are not involved in this other than they were interested that we knew what was going on. The County and Conifer Park have to work that out.
On Friday the 11th we had a dedication of an historical marker at the end of Freemans Bridge Road, at the restaurant that is the original property dates way back into the early 1800’s. The Seeley House, the owner of the current restaurant Pat Popolizio hosted it and put up one of the famous markers as a historic site.
Also on Friday the 11th we had a meeting with the Clifton Park Supervisor and the Chairman of their Water Authority. We were going over the current agreement to sell them water and how does this tie into the needs for Rexford and some other things that they are looking at. They were looking at a possible future increase and do we have the capacity to sell them more water? We all know what is being talked about as water coming down related to the Saratoga County financing of water from the Hudson River. They are interested in our water too.
The interesting feature to me was that they want to talk to us about wholesale pricing agreement. In a fact what they are saying is could we sell them water and since the water we sell them would be on their property as their lines and we wouldn’t be picking up any of the O & M costs on that sort could we be just selling them bulk price. We have taken this under consideration; our Superintendent will let us know what that is about.
Last Saturday, May 12th the Schenectady County Annual Fishing Derby was held at the Indian Kill Park.
Wednesday, the 16th I met with Pastor Wayne Elston of the Believers Fellowship Church regarding their bi-annual prayer service for intentions.
On the 18th the Local Government Council meeting has been cancelled.
Also on the 18th there is a meeting with Metroplex to discuss the GSA Park and the status and where we are with that.
The second item is that they have all of these properties down there from the Schenectady IDA which is now operated by the Metroplex staff. We are concerned and our Assessor has been working up data along with the Town Administrator to review the status because our assessments don’t come anywhere close. We’re way higher in assessments then what they have got these IDA properties assessed at. They are covered by PILOTS, so we are going to see since we renegotiate PILOTS all of the time many times with no information or input from the Town why can’t they renegotiate a PILOT not only for the owner/operator but for the Town and get the PILOT in balance with the assessment.
On Wednesday May 23rd the Annual Memorial Day Parade will be held down in the Village of Scotia.”
Councilman Bailey – “You said that the potential liability on the sewer plant is 2%, the Schenectady plant, 2% of what figure?”
Supervisor Quinn – “On any project, no matter what it is, our share would be 2%, far different than the millions that we have been talking about.”
Councilman Quinn – “Mr. Supervisor, if the board would be kind enough to indulge me since the folks from Lowe’s were kind enough to show do you mind if I ask a very brief question?”
Supervisor Quinn – “Please do.”
Councilman Quinn – “Has any further discussion taken place with regard to the re-routing of the sewer line so it is not necessarily underneath that one corner of your parking lot?”
Marty, Chazen Company’s Project Manager – “After last weeks meeting I discussed with Lowe’ s the request of the board the potential to look at the re-routing of the sanitary sewer. We briefly looked at it, we discussed some of the inverts and internally between us we are still evaluating the options for it to be able to come back with a response to the engineering department and the board.”
Supervisor Quinn moved ahead with the agenda items.

RESOLUTION NO. 131-2007

WHEREAS, the Town of Glenville has budgeted for a Planning Department internship position for 2007; and
WHEREAS, the Town is desirous of hiring an intern for the summer period, at least, to assist Planning staff on a number of tasks including updating the Vacant Commercial and Industrial Buildings Inventory, producing various maps using the Town’s GIS, adding various information and links on the Town’s website concerning storm water management practices and requirements, compiling existing traffic volume and accident data and creating a GIS database for mapping of the traffic information, assisting staff with planning/zoning application review, etc.; and
WHEREAS, the Town of Glenville has customarily hired graduate students from the State University of New York at Albany’s (SUNYA) Graduate Planning program; and
WHEREAS, Matthew L. Smith, 17 Wicken Square, Colonie, and a student currently enrolled in SUNYA’s graduate planning program, has applied for the position and has been interviewed by Planning staff; and
WHEREAS, Planning staff contacted two of Mr. Smith’s references, one academic and the other work-related, and both highly recommended Mr. Smith;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby appoints Matthew L. Smith to the position of Planning Department intern, effective May 21, 2007, and terminating on August 31, 2007, at a pay rate of $10.00 per hour, up to the maximum amount of the budgeted line item, with no benefits.

BE IT FURTHER RESOLVED, that the Director of Human Services is authorized to employ one additional Park Security Worker for the same term and compensation as above upon the approval of the Town Administrator.

WHEREAS, I am introducing a proposed Local Law to be known and be cited as the “Public Display of Fireworks Law of the Town of Glenville” to be added to the Code of the Town of Glenville; and
WHEREAS, a duly scheduled public hearing must be held in order to change such a law,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville will meet at the Glenville Municipal Center on Wednesday, June 20, 2007 at 7:30 P.M., or as soon thereafter as can be reached, at which time and place will hear all persons interested in this proposed local law to be added to the Code of the Town of Glenville; and
BE IT FURTHER RESOLVED that the Town Clerk be, and she hereby is directed to prepare the proper notice of said hearing in accordance with law.

WHEREAS, the Superintendent of Highway requests the purchase of one 2006 Challenger MT 455B 4wd HVAC enclosed cab [Item 2] from state contract award number 20365; and

WHEREAS, Richard D. LeClair, Commissioner of Public Works has recommended that the Town purchase one trailer mounted sectional sewer rodder; and
WHEREAS, that the sewer rodder is instrumental in cleaning and maintaining storm and sanitary sewer lines; and
WHEREAS, the funding for the sewer rodder is budgeted in the sewer fund; and
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby authorizes the Commissioner of Public Works to advertise for bids on the purchase of one trailer mounted sectional sewer rodder; and
BE IT FURTHER RESOLVED, that all bids must be received in the Town Clerk’s Office, 18 Glenridge Road, Glenville, New York by no later than 10:00 AM, on June 4, 2007 and opened on June 4, 2007 at the Glenville Municipal Center, 18 Glenridge Road, Glenville, New York at 10:15 AM, and
BE IT FURTHER RESOLVED, that this purchase shall be funded from the Sewer District No. 9, Equipment 40.09.8130.2000.

Discussion…
Councilman Bailey – “This resolution would have the town accept the low bid of Carver Construction. If you recall that bid was provided to the town back on October 10, 2006 and found to be the low bidder at that time.
Apparently through a gentlemen’s agreement Carver Construction has said that they would honor that bid through the ensuing months and the uncertain economic climate and we still feel that that is a reasonable bid and we want to proceed with it.”
Supervisor Quinn – “In this case we have been blessed that he held the bid even though fuel and oil are going up he has held on the bid.”
Councilman Rosenberg – “I am glad to see that this got added on tonight so that we can keep this process going rather than have to wait for our next meeting. I am glad that we are addressing it tonight.”
Resolution No. 139-2007

WHEREAS, on April 4, 2007, the Town Board of the Town of Glenville found and determined that it was in the public interest to provide for the improvements to the facilities of Alplaus Sewer District No. 1 and Alplaus Sewer Extension No. 1; and
WHEREAS, the contract for the general construction of Alplaus Sewer District No. 1 and Alplaus Sewer Extension No. 1 – Contract 1-06G (Sanitary Sewer Main and Pump Stations Construction) and 1-06E (Electrical Construction for Pump Stations) was put to bid with the bids being opened on October 10, 2006; and
WHEREAS, the bids have been reviewed by Richard D. LeClair, Commissioner of Public Works and Mark L. Kestner, the town designated engineer, and both of whom recommend awarding the contract to the low bidder: Carver Construction Inc. of Altamont, NY.
NOW THEREFORE BE IT RESOLVED that the Town Board of the Town of Glenville hereby accepts the bid of Carver Construction, Inc., 494 Western Turnpike, Altamont, NY, and awards it the contract for the general construction of Alplaus Sewer District No. 1 and Alplaus Sewer Extension No. 1 – Contract 1-06G (Sanitary Sewer Main and Pump Stations Construction) and 1-06E (Electrical Construction for Pump Stations) as set forth in the bid specifications at a cost not to exceed $2,091,678.00; and
BE IT STILL FURTHER RESOVED that Frank X. Quinn, Supervisor of the Town of Glenville, is authorized to sign all documents necessary to complete this contract and the project.

Administrator’s Report:
PERSONNEL:
--The Engineering Assistant position recently approved for hire by the Board has been advertised and was approved by County Civil Service on May 15. This position is expected to be filled by mid-June.
--Mr. Matthew Holub was hired as a seasonal (5/18-9/30/07) Park Security Worker to assist with security and safety of the Town Park’s. It is anticipated that one additional seasonal worker will also be hired shortly.
--The Assistant to the Comptroller, Mr. Jeffrey Prescott, will begin employment with the Town on Monday, May 21.
--The Planning Department completed interviews for a summer Intern and selected Matthew Smith (SUNY Albany Graduate candidate) for consideration by the Board. The intern will be utilized to perform a number of needed actions for the Town such as: updating the Commercial and Industrial Buildings and Properties Inventories; integrating GIS into our land use map; traffic volume projects, etc. Planning is budgeted $10,000 for this project; but is expected to expend less than half of the authorized budget for this effort.
OPERATIONS:
--On May 11th, the Supervisor signed a license agreement, which takes effect on May 14, 2007, with the General Services Administration for permitted use of Building 403 of the Scotia Naval Depot. The agreement is for a six month period and can be extended for additional six month periods at our request. The building will be available for storing and preserving Town equipment. The Town’s existing liability insurance is sufficient to cover us for the use of this property. We are making arrangements with GSA for access to the property.
--A meeting was held on May 11th at the request of the Town of Clifton Park to discuss continued provision of Glenville aquifer drinking water pursuant to our Agreement which expires in 2009. Clifton Park has the opportunity to connect to the County water supply once their contract with Glenville expires. They estimate that their water needs will increase to over 1 million MPD by 2009 and are interested in renegotiating a contract with Glenville as a “larger volume” user. Discussions will continue with Clifton Park on this process.
--A meeting was held with the Alplaus Resident Association on May 7th to review the status and preliminary time line of the municipal sewer project. The State Comptroller approved the required submission for the extension of the Alplaus sewer project on May 14. Last evening, the Board passed a resolution accepting the bid of Carver Construction for $2,091,678 and authorizing the Supervisor to execute the contract for this project. Site engineering for location/access of pumps, pipe, etc. and to obtain necessary information from added users to this sewer system that are outside of the Town are underway. Schenectady City will need to approve the out of town users being proposed for connection to the Alplaus sewer district.
--Accompanied the Supervisor to a meeting on May 8th with Schenectady County to discuss money owed to the County by Conifer Park for municipal sewage waste and treatment. Apparently, Conifer has not paid for waste removal nor operations and maintenance charges due the County. Conifer Park is up to date with payment of sewer charges by the Town. The County will be sending Conifer Park a bill for payment. This matter does not require any action by the Town.
--A May 5th meeting was held between Town and Schenectady City Officials to discuss the current status of the City’s Sewage Treatment Plant and anticipated operation and maintenance needs of that facility. The City advised that their Sewer Plant is operationally sound and will continue to operate as designed for many more years. The Plant is rated for 18.2 MGD and is currently running at less than 15 MGD, so there remains ample room for increased capacity. The City is in process of examining operational efficiencies for the plant that could include co-generation and
other energy use improvements, which could be a positive factor in keeping sewage treatment fees reasonable. The City is currently making necessary repairs to pumps and other infrastructure located and operated exclusively for the City which is not related to sewage services provided to Glenville. Therefore, the costs of such repairs will be borne 100% by the City with no chargeback to Glenville. According to City Officials, DEC discharge issues with the operation of this Plant should be rectified shortly. Pursuant to the Sewage Contract, the Town of Glenville is responsible for a percentage of capital operations and maintenance costs of the sewer system beginning at Freemans Bridge Road. This cost to the Town is calculated on our percent of sewage flow compared to total flow of all customers. The Town’s share of capital costs are less than 2% of total project costs. Shortly, the Town will receive a bill from the City to pay for its share for required screening repair costs.
City officials explained that the “hold harmless” clause in the contract is intended to mean that if a catastrophe or major disaster (flood) were to render the plant inoperable, the Town could not sue the City for failure to process sewage.
--Schenectady County Office of Emergency Management is planning to conduct a follow up full scale exercise on September 15th, 2007 in Glenville. The exercise scenario will be designed around a terrorist incident releasing chlorine gas which threatens the Base and surrounding community. The exercise will afford an opportunity to evaluate our capability to simulate emergency notification to residents of a pending threat and issue appropriate protective measures. We advised the County of our intent to participate in this exercise. The Glenville Emergency Management Plan is currently being revised. The County will host a planning meeting on June 21 to review the details of this exercise. I anticipate roles for Town Police, Planning, Highway, Counsel as well as the Board during this
exercise.
--The Town’s “draft” Strategic Plan (Mission, Vision and Goals) will be completed and submitted for Town Board
review by the end of this month. All Town Department’s have provided quality input into this process.
--The Town Labor/Management and Safety and Health Committee will be established in the next few weeks with the following representatives: Jamie MacFarland, Chief Ranalli and/or Lt. Conley; Rick LeClair and/or Jeff Gemmette; Larry Colleton; Chris Flanders; CSEA, Highway and PBA identified representatives; and the Town Administrator. The first priorities of this Committee will be to insure we are fulfilling employee safety and health requirements and to coordinate development of the state mandated Workplace Violence Prevention Program that is required of all public employers.
--The Planning Department provided statistics on the status of planned residential development currently pending review or processing by the Town. The breakdown of those statistics include:

Townhomes 87 ( 6%)
Total possible units 1,421 (100%)
Of the 1421 proposed units, 78% are multiple family projects and 22% are single family units.

--On May 10th, Jamie and I toured the Glenville Senior Citizen Center and met briefly with their Board. We have been advised that membership is up slightly.
FISCAL:
--The Supervisor, Comptroller and I met to review this year’s Town budget and operational obligations. While there are no unbudgeted shortfalls, we have advised appropriate Department Heads (Highway and Police) to closely monitor overtime expenses, Consulting Engineering services requested directly by the Town and other expenditures.
--The 2006 retroactive pay was included in the current pay period for non-represented personnel (where applicable) and for CSEA members. The 2007 retroactive pay and salary adjustments will be included in the next payroll period. Changes to health care premium/prescription reimbursement for those affected will take effect July 1, 2007.
Supervisor Quinn – “I would like to compliment Councilwoman DiGiandomenico, we got the storage place, you pushed it, and we got it. Congratulations!
On the goals and objectives, you have heard me say this before; once we have those they will become the grist of our work session meetings. We will go over so many of those goals each meeting so we’re monitoring in a reoccurring on-going way where are we on this goal, that goal and the other goal no matter what else we have to do this so that we can keep our focus and move down the road.”
New Business
Councilman Rosenberg – “In regards to the Freemans Bridge Master Plan, I don’t know if that is on our agenda anytime soon to discuss this. I think it just sort of died the last time and that was the end of it.
We had a draft letter that was going to the Village of Scotia regarding collaboration efforts, has anything happened with that?”
Supervisor Quinn – “Yes, that letter will be going out in tomorrow’s mail.”
Richard LeClair, Commissioner of Public Works – “This is something that you have to do while you are working with DEC to announce that the “Final Draft for Phase II Stormwater Programs Annual Report” for the period of March 1 0, 2006 to March 9, 2007 is complete and will be available for review on Monday, May 21st . A notice of this publication will be in the Daily Gazette, the town’s official newspaper on Monday, May 21, 2007.
This begins our required 30 day review and comment period. It is an opportunity for the public to become involved and they are strongly encouraged to participate in this process. The report will be available at the following locations, Town Hall, Glenridge Road; Glenville’s website; Scotia-Glenville Senior Center, Worden Road; Highway Department and the Glenville Branch of the Schenectady County Library.
The report outlines the town’s progress over the past for the Phase II Stormwater program.
On June 20th we will give our annual report after the comments have been submitted. Compared to last year we are way ahead of schedule.
